When a US plant asks for a high-purity solvent or specialty chemical, the first commercial conversation often centres on grade, package, price and lead time. Import compliance appears later, sometimes after the sample has passed. That sequence creates avoidable risk. The proposed importer, TSCA status, hazard communication and transportation responsibilities should be understood while the technical qualification is still being designed.
The aim is not to turn every buyer into a regulatory lawyer. It is to give procurement, EHS, quality and the customs team a shared set of facts. A supplier can support the review, but it cannot silently assume legal responsibilities that belong to an importer, manufacturer, broker or shipper.
Identify the substance and intended import route
Start with the exact chemical identity, CAS number where applicable, composition, grade, intended use, annual volume estimate, US destination and importer of record. For a mixture, record enough constituent information for the responsible parties to assess status while protecting legitimate confidential business information. A trade name without chemical identity is not a sufficient import file.
EPA states that importers of chemical substances, mixtures and articles may be subject to TSCA requirements. Its import guidance describes positive certification when chemicals comply with applicable TSCA rules and orders, and negative certification for chemicals not subject to TSCA. It also points importers to inventory status and premanufacture or significant-new-use requirements. The correct certificate depends on the actual substance and route; copying language from an unrelated shipment is poor control.
Ask the right TSCA questions
The practical checklist begins with inventory and restrictions. Is each substance on the TSCA Inventory, exempt, or otherwise lawfully introduced? Are there rules, orders, consent agreements or significant-new-use requirements relevant to manufacture, processing, distribution, use or disposal? If a substance is new, has the necessary EPA review occurred? The importer should document how it reached its conclusion and retain the evidence appropriate to its compliance procedure.
A supplier statement can help, especially when it identifies the substance, product and basis of the statement. It should not be mistaken for the importer’s own determination. EPA’s guidance is useful because it frames the importer’s duties and the relationship with US Customs and Border Protection. Connect OSHA hazard communication with the product file
OSHA’s Hazard Communication Standard specifies the information required in a safety data sheet and uses a 16-section format. The SDS needs to match the product and supplier route being offered. Check identifiers, emergency contact information, classification, composition, first aid, firefighting, accidental release, handling, storage, exposure controls, physical properties, stability and transport information for consistency.
The SDS is not a CoA. A lot CoA reports results or conformance against the product’s release specification; the SDS communicates hazard and safe-use information. US buyers generally need both, with revision and lot control kept distinct. Product labels, SDS identifiers, purchase description and receiving records should align.
Do not leave dangerous-goods planning to the carrier
PHMSA explains that the person offering hazardous material for transportation is responsible for proper classification, packaging, marking, labelling and documentation, among other duties. Responsibilities must be allocated for the proposed shipment. Confirm the transport classification, authorised package, closure instructions, marks, labels, shipping paper information, emergency response details and training status of relevant personnel.
For drums or IBCs, review the operational route as well: unloading equipment, storage limits, grounding or bonding where applicable, sampling and internal transfer. A package that is legal to ship may still be unsuitable for the site’s receiving and dispensing system. Keep technical qualification specific
Once legal and logistics roles are visible, evaluate product performance. High-purity solvent buyers may compare identity, assay, water, organic impurities, non-volatile residue, acidity, colour and package. Semiconductor uses may require an agreed trace-metal panel and particle method. Analytical acids require reagent-blank work in the laboratory’s own method. Custom formulations need customer-approved composition, critical attributes and scale-up evidence.
Request a controlled specification and representative CoAs. Agree the test methods and units before comparing limits. Evaluate a sample associated with the proposed production and filling route. Record which package was tested. The product finder and performance tables provide a starting framework, while the customer’s process decides acceptance.
US import-readiness checklist
- Exact chemical identity, composition, grade and intended use.

A credible US supply proposal makes assumptions visible. It does not claim that TSCA, OSHA or transport compliance is “handled” without naming the route and responsible party.
